MYCHART AT UNIVERSITY HOSPITAL– ON BEHALF OF UNIVERSITY HOSPITAL AND THE AMBULATORY CARE CENTER STATEMENT OF TERMS AND CONDITIONS OF USE

INTRODUCTION:

University Hospital is pleased to provide you with information about its Web-based, electronic access portal to parts of your medical record. Under limited circumstances, you may also receive access to the medical record of another individual who has designated you to receive such access. This defined scope of access to University Hospital’s and The Ambulatory Care Center’s electronic medical record is called MyChart.

To request a MyChart account for yourself, submit a “MyChart Sign up Form.” There are representatives at University Hospital and in The Ambulatory Care Center to assist you in creating a MyChart account. You must indicate that you have read this MyChart Terms and Conditions page and that you agree to comply with these Terms and Conditions. If you have been designated by another individual to request and to receive personal health information on behalf of that person, please request a MyChart account for a third party, by submitting the appropriate MyChart – Proxy Form (for Child, Adolescent or Adult). You will also have to indicate that you have read this MyChart Terms and Conditions Page and that you agree to comply with the Terms and Conditions.

Please remember to come back and check this page every so often, as the MyChart Terms and Conditions are likely to be updated periodically.

We think it is important for you to know how University Hospital and The Ambulatory Care Center at University Hospital will handle personal health information that we communicate via the web-based MyChart system and the Internet. This Statement of Terms and Conditions outlines our practices and confirms that we are sensitive to your right to privacy and to the security of your personal health information.

LIMITATIONS ON RESPONSE TO ELECTRONIC COMMUNICATION:

University Hospital and The Ambulatory Care Center will use their best efforts to provide a timely telephone and/or electronic response to your electronic inquiry requesting an appointment with your health care provider. Sometimes the hospital and clinic staff that will need to respond to an electronic inquiry or other communication may not be immediately available. In such cases, you may have to wait for a response. University Hospital and The Ambulatory Care Center will respond to an electronic request for an appointment within three (3) business days. Accordingly, you should not submit electronically via MyChart any request for an appointment requiring immediate attention.

You should call your health care provider’s office if you have any questions or health care needs. You should seek immediate attention from a health care provider if your needs are of an urgent nature.

In addition, with respect to an electronic request that we receive from you, University Hospital and/or The Ambulatory Care Center will only be able to respond to such communication based on the information that is provided to us. If there is insufficient information provided, we may be unable to provide you with a timely response or any response. We also may be unable to provide you with accurate and reliable service.

Please be advised that the scope of electronic access is limited to requesting an appointment with your health care provider. There is no right to appeal a decision by University Hospital regarding the scope of access or quantity of information contained in MyChart.

MyChart may offer links to related medical and other sites on the Web that are not managed by University Hospital. These Web site links are intended to be for a user’s informational purposes only and you use this information on these external Web sites at your own discretion. University Hospital has not verified and should not be deemed as having verified the accuracy and/or completeness of the information in/on these Web sites, and the user should not rely on any of the information that is found on these Web sites for any purpose including, but not limited to, treatment or diagnosis. University Hospital does not endorse or guarantee in any way the information on such Web sites.

MYCHART ELIGIBILITY:

An individual must be age 13 or older to request a personal MyChart account.

A Minor Child is defined for purposes of MyChart as an individual at any age under 13, i.e., up through and including age 12 (inclusive). A parent or guardian of a Minor Child (Children) ages 0 – 12 may request access to a MyChart account for a Minor Child by following the Terms outlined in the “Proxy Access” section of this Statement of Terms and Conditions.

A parent or guardian of an Adolescent Child (Children) ages 13 – 17 will be granted limited access to the adolescent’s MyChart account. A parent or guardian may request full access for the Adolescent Child by following the Terms outlined in the “Proxy Access” section of this Statement of Terms and Conditions. Under applicable State and Federal law, there are certain types of medical information about an adolescent that a parent or guardian may not request and/or receive without the consent of the adolescent. Therefore, University Hospital reserves the right to restrict parental access to medical information about an Adolescent Child as required by State and Federal law.

As a user or a potential user of MyChart, you may be referred to the Health Information Management Department at University Hospital from time to time. We ask that you cooperate with this instruction and that you direct your requests and inquiries to a Service Representative in the Health Information Management Department at University Hospital who will be available to assist you.

PROXY ACCESS:

A parent or guardian of a Minor Child (Children) ages 0 – 12 may request access to a Minor Child’s MyChart account by completing the “MyChart Child Form.” Such access will only be granted to individuals determined to have parental rights and/or legal guardianship with respect to medical decisions for a Minor Child and a right to receive the personal health information of a Minor Child.

A parent or guardian of an Adolescent Child (Children) ages 13 – 17 may request full access to an Adolescent Child’s MyChart account by completing the “MyChart Adolescent Form.” Please note that both the adolescent and parent or guardian must complete and sign the form.

An individual who presents a proper Consent Authorization and/or a Court Order directing specific access to an individual’s medical record and/or personal health information of a person of any age should proceed to the Health Information Management Department at University Hospital to request assistance with their specific situation.

There is no pre-determined number of individuals who may be granted Proxy Access to the MyChart account of another individual as each situation will be determined on a case to case basis.

When Proxy Access is granted, a MyChart account will be created in the name of the patient, with the right of access in the name of the individual or individuals who have been authorized to serve as the proxy for the patient. The individual(s) who are granted Proxy Access are required to advise the Health Information Management Department immediately if his/her legal relationship with the patient changes in any way that may or does affect the granting of proxy access. Notice shall be given in writing to the Health Information Management Department at:

within five (5) business days of the event triggering a change in Proxy Access. Every reasonable effort should also be made to contact and inform the Health Information Management Department immediately by calling 973.972.4013 and stating that you would like to report a change in Proxy Access to MyChart.

University Hospital reserves the right to revoke Proxy Access to MyChart at any time for any reason.

All Proxy Access for another person will cease immediately upon the death of that other person.

E-MAIL PRIVACY:

Users, including patients, who sign-up and are granted active MyChart accounts should be aware that they will be notified via e-mail when there is new information, usually of a medical nature but not always, to be reviewed on MyChart. This means that any person with access to a MyChart user’s e-mail account will be able to see this notification. Third parties that may be able to see a MyChart notification include, but are not limited to, a user or patient’s spouse, an employer or anyone else that can access a user or patient’s e- mail account. Although no personal health information or information of a sensitive nature will be communicated in this way, the notification itself that new medical or other information is available by accessing MyChart may nevertheless be information that a user or patient may not want others to know or to view. Accordingly, all users of MyChart including patients should carefully consider and take this into account when providing an e-mail address to create a MyChart Account.

In addition, please know that if you send us an e-mail communication of any kind, it may be shared with staff at University Hospital and/or The Ambulatory Care Center and with anyone else who may need to know and to assist our healthcare providers in providing patient medical care. A patient’s confidential personal health information in MyChart will be accessible only to appropriate clinical and administrative staff.

SECURITY AND CONFIDENTIALITY:

We afford the same degree of confidentiality to medical information communicated via MyChart as is given to medical information stored in any other medium by University Hospital. University Hospital is committed to protecting the confidentiality of your medical information. We limit our employees’ access and ability to enter and/or to view information based upon their role in your care. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information.

We shall identify the records released and note the time and date of access each time a user, including a patient, accesses MyChart. We have taken appropriate steps to make all such information as may be received from our online visitors as secure as possible against unauthorized access and use.

For other than general information viewing, MyChart must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal (Netscape or Internet Explorer versions 5.0 or greater). Our SSL web server uses authentication and encryption technology.

You can tell when you are secure by looking at the location (URL) field. If the URL begins with https:// (instead of http://), the document comes from a secure server. This means your data cannot be read or deciphered by unauthorized individuals. You can tell whether you are truly connected to University Hospital by viewing the digital certificate. This certificate verifies the connection between University Hospital’s server public key and the server’s identification.

User names and passwords provide two layers of authentication and are stored in an encrypted database that is isolated from the Internet. As a MyChart user, your role in maintaining the security of your personal health information is: (1) Changing your password on a regular basis, and (2) Keeping your Log In ID and password confidential.
